    Title: 臺灣酒駕政策與酒駕者再犯行為之關聯性分析

    Abstract: 本研究使用2007年至2016年全國酒駕取締資料,探討我國「道路交通管理處罰條例第35條」與「刑法185條之3」之處分與修法對於酒駕的嚇阻成效與修法成效,目的在於觀察我國酒後駕車之處分是否能有效降低酒駕者再次酒駕之機率,並且評估政府修訂酒後駕車相關法律是否能降低酒駕者再次酒駕之機率。
    實證模型採用Logit機率模型研究臺灣酒駕處分與酒駕修法之嚇阻效果,研究酒駕處分與修法在為酒駕累犯、整體酒駕、累犯之初犯與整體酒駕之初犯等四個群組樣本的嚇阻成效差異。實證結果發現,我國酒後駕車的處分對於整體酒駕確實存在嚇阻力,但吊扣駕照與一般取締的刑事處分對於酒駕累犯較無法降低酒駕再犯之機率;修法成效方面,以2011年12月修刑法185條之3較無成效,該次修法無法降低酒駕者再犯之機率。
    ;This study uses the 2007-2016 Taiwan’s drunk-driving ban data to explore the deterrence effect of the penalty and law amendment of the Article 185-3 of Criminal Law and the Article 35 of Traffic Regulation. We examine whether the penalty and modification of the law can effectively decrease the probability of recidivism.
    We used the logistic probability model to analysis the deterrence effect of drunk-driving penalty followed by the law amendment modification. Besides, we examine whether or not the deterrence effects are distinct among four groups of drunk drivers: the drunk-driving recidivists, all drunk-drivers, the first offense of the drunk driving recidivists, and the first offense of the all drunk-drivers. Our empirical results show that the drunk-driving penalty has a deterrence effect on the reoccurrence of drunk driving behaviors. But license suspension and criminal penalty of general enforcement are less effectively in decreasing the probability of recidivism.
